Federal Education Moves: Special Ed and Civil Rights Oversight Shift to HHS and DOJ

The U.S. Department of Education is transferring special education oversight to the Department of Health and Human Services and civil rights enforcement to the Department of Justice.

While federal student rights remain unchanged, organizations like the Council for Exceptional Children (CEC) are concerned the shift could create confusion and weaken enforcement for students with disabilities and families seeking civil rights protections.
